Terms of Use — Israel
Draft: this text is under review and not yet in force.
Version IL-[DATE] · Last updated: [DATE]
Welcome to LIVEDATE. These terms (the "Terms") govern your use of the app in Israel. By creating an account, you accept them. Please read them carefully.
These Terms are available in Hebrew, English and French. [LAWYER: if the versions differ, the Hebrew version prevails.]
1. Who we are
LIVEDATE is published by Pixela (Osek Patur), registration number [TO BE DECIDED], [ADDRESS — TO BE DECIDED] ("we", "us"). Contact: support@livedate-app.com.
2. The service
LIVEDATE lets you meet people in two ways:
- "Nearby": discover people close to you, with a rounded distance;
- "Live": check in at a place (bar, restaurant, hotel…) and see the people at the same place or close by, for a limited time.
When two people like each other, it's a match: they can chat and suggest meeting up.
3. Paid plans
LIVEDATE is free to start. Paid plans (LIVEDATE+, Gold) and one-off purchases (for example a boost) may be offered.
- Purchase: only in the app, using your store's payment method (Google Play). The final price in shekels, the duration and what is included are shown to you before any purchase.
- Renewal: a monthly subscription renews automatically every month, at the same price, until you cancel it. [LAWYER: disclosure obligations before renewal.]
- Cancellation: you can cancel at any time, in a few taps, from your store (Google Play → Payments & subscriptions → Subscriptions). Your benefits stay active until the end of the period you have already paid for.
- Right to cancel and refunds: you have the rights provided by the Israeli Consumer Protection Law (חוק הגנת הצרכן, התשמ"א-1981), in particular for cancelling a distance transaction and an ongoing transaction. [LAWYER: time limits, cancellation fees, how this works with refunds handled by Google Play.]
- If we withdraw a plan or change its price, we will tell you in advance in the app; the new price only applies from the next period, and you can cancel before then.
4. Who can sign up
To use LIVEDATE, you must:
- be 18 or older;
- be a real person, and have only one account;
- not have been banned from LIVEDATE before.
You are responsible for keeping your password confidential and for everything that happens on your account.
5. Your profile
Your profile must be genuine:
- your photos must show you, and your main photo must clearly show your face;
- your age must be accurate;
- you must not pretend to be someone else.
The Verified badge means our moderators compared a live selfie with your photos. It is removed if you change your main photo. It is not an absolute guarantee of a person's identity.
6. Rules of conduct
On LIVEDATE, you must not:
- harass, threaten, insult or intimidate anyone;
- post hateful or discriminatory content (origin, religion, sexual orientation, gender, disability…);
- post sexual or violent photos or content, or send unsolicited sexual content;
- post photos of other people without their consent;
- offer or request paid sexual services, or any illegal activity;
- advertise, solicit or ask for money;
- create fake profiles or automated accounts, or scam other members;
- share other people's personal information (address, room number, phone number…) without their consent;
- check in at a place where you are not, or get around the app's checks;
- copy, scrape or exploit other members' data;
- disrupt the app or try to access data that is not yours.
7. Reporting and moderation
- You can report a profile or a chat (flag on the card, ⋮ menu in the chat). The reported person is blocked for you immediately.
- You can also block someone: you no longer see each other. Your blocks are in Profile → Blocked people.
- Our moderators review reports and may, depending on how serious it is: remove content, suspend an account temporarily or disable it permanently.
- When action is taken against your account, the app tells you. If you think it is a mistake, you can challenge it by writing to support@livedate-app.com: your request will be reviewed again.
- In case of clearly illegal content or danger, we may inform the competent authorities.
8. Your safety
LIVEDATE connects people, but does not run background checks on its members and cannot guarantee how they behave. For a first date:
- meet in a public place, with other people around;
- tell someone you trust ("Share my date" does it for you);
- never give out your address or room number;
- never send money to someone you met on the app;
- if you are in danger, use "SOS help" or call the police (100), Magen David Adom (101) or the fire service (102);
- after a sexual assault, free and anonymous helplines are available: 1202 (women) and 1203 (men), rape crisis centers; for emotional support, ERAN: 1201. [TO VERIFY: numbers and opening hours.]
You alone are responsible for the meetings you choose to have.
9. Your content
You keep ownership of your photos, videos and texts. By posting them, you allow us, free of charge and for as long as your account exists, to host them, adapt them technically (resizing, compression) and show them to other members, only to run LIVEDATE. We do not use them for advertising without your consent.
You confirm that you have the rights to what you post.
10. Messages and notifications
The app's notifications (match, message, drink invite, end of check-in) are part of the service; you can set them in Profile → Notifications. We send you no advertising messages (notification, email, text message) without your prior consent, and you can withdraw that consent at any time. [LAWYER: section 30A of the Communications Law.]
11. Our liability
We do our best to make LIVEDATE work properly and safely, but we cannot guarantee that the service will always be available or error-free, or that you will meet someone.
We are not responsible for how members behave, online or when meeting, or for the content they post, unless we were informed and did not act promptly. Nothing in these Terms limits the rights Israeli law gives you as a consumer.
12. Pausing and deleting your account
- You can pause your profile at any time (Profile → Settings): you no longer appear in discovery, and your chats are kept.
- You can delete your account at any time, from the app (Profile → Account → Delete my account). Your profile, photos, matches and chats are permanently deleted. Deleting your account does not cancel a running subscription: cancel it in your store too (section 3).
- We may suspend or disable an account that does not follow these Terms (section 7).
13. Personal data
How we use your data is described in our Privacy Policy (Israel).
14. Changes to these Terms
We may update these Terms. If there is an important change, we will tell you in the app before it takes effect and ask you to accept the Terms again. If you do not agree, you can delete your account and cancel your subscription.
15. Governing law and disputes
These Terms are governed by the laws of the State of Israel. If there is a problem, please contact us first at support@livedate-app.com: we will look for an amicable solution.
If the disagreement continues, the competent courts of Tel Aviv-Jaffa may hear the matter, subject to the jurisdiction rules that protect consumers.
